The court must determine the mandator's incapacity and verify the existence and validity of the mandate. Given the complexity of the procedures, it is recommended that a notary be consulted to obtain a judgment confirming the coming into force of the mandate.
The search for the mandate of protection at the Chambre des Notaires du Québec and at the Barreau du Québec is mandatory to undertake the homologation of a mandate.
