When a notarial will is left at the time of a person's death, no probate is required as it is an authentic document. On the other hand, a deceased person can leave a witnessed will, a holograph will or a will drawn up by a lawyer. In Quebec, it is mandatory to have the will probated by the court or by a notary to ensure the validity of the will.
The liquidator of the estate can take care of the court proceedings on his own, but due to the complexity of the procedures, it is recommended that a notary be involved.
Will searches at the Chambre des Notaires du Québec and the Barreau du Québec are mandatory to undertake a will probate.
