What is an incapacity order?
You've probably heard tragic stories of people who have been in accidents and have lost their means, fallen into comas or lost their mental faculties. The incapacity mandate is designed to help the people who enter these cases and their families organize themselves.
The incapacity mandate will declare the person subject to the mandate as incapable of exercising his or her civil rights and will appoint a mandatary to exercise his or her civil rights. This procedure is particularly important for families wishing to choose a mandatary for the incapable person and avoid appointing a mandatary in an emergency if no mandate is issued.
This mandate is not exclusively reserved for senior citizens, and also covers accident victims who have fallen into a coma or victims of mentally incapacitating illness.
