- The publication of a chattel mortgage aims to make its existence known to third parties and thus make it enforceable.
- The publication of the moveable hypothec by the hypothecary creditor will allow him to control the rank of his security over time, subject to certain specific rules set out in the Civil Code of Québec.
- It should be remembered that the publication of the moveable hypothec will be valid for a period of 10 years from the signing of the hypothec deed. If it is to remain in force beyond that date, the creditor must renew the registration in the RDPRM in order to maintain its priority rank.
- It is important to remember that a non-possessory chattel mortgage, even if duly signed, cannot be enforced against a third party if it is not published.
